Privacy Policy
Effective October 3, 2026
Overview
This Privacy Policy describes how FORTYNINE AND A HALF LABS, LLC ("we," "us," or "our") collects, uses, and shares information when you use OrbView ("the App"). OrbView is designed to use the minimum data necessary to provide its features. Most of your personal data never leaves your device.
1. Information We Collect
Location Data
With your permission, we access your device's location while you are using the App to compute which satellites pass over you, calculate visibility windows, and display your location name. Your coordinates are stored on your device. Your location leaves your device only in these cases:
- Sky conditions: to estimate cloud cover and viewing conditions, your coordinates are sent to our servers, which round them to roughly 11 km (7 miles) before requesting a forecast from our weather data provider. We do not store these coordinates.
- Daily Brief: if you turn on Daily Brief notifications, your coordinates, location name, and timezone are stored on our servers to schedule your notification (see below).
- Location name: your device's built-in location service converts your coordinates into a city name.
We do not access your location in the background.
Device Data Stored Locally
The following data is stored exclusively on your device and is never transmitted to our servers:
- Satellite sighting history and log
- Badges and achievements
- App preferences (units, alert timing, notification settings)
- Cached satellite descriptions ("Intel")
- Subscription status
- Pass alerts you schedule (these are delivered by your device, not our servers)
Daily Brief Notifications
Daily Brief notifications are optional. If you turn them on, we store your device's push notification token, your coordinates and location name, your chosen notification time, and your timezone on our servers solely to deliver your Daily Brief. Turning off Daily Brief in the App deletes this information from our servers. We never use it for any other purpose.
Analytics Data
We collect event data about how you interact with the App, such as which screens you view, which features you use, and general app performance. This data is linked to a random identifier generated by the App, not to your name, email address, or account. Our analytics provider may use your IP address to infer your approximate location (such as country or city). We use this data only to understand usage patterns and improve the App. It is processed by a third-party analytics service operating under data processing agreements that restrict its use to analytics purposes only.
Advertising Identifiers (Free Tier)
The free tier of the App displays ads served by third-party advertising partners. These partners may use device identifiers, your IP address, and information about your device to serve, measure, and limit the frequency of ads.
On iOS, we ask your permission through Apple's App Tracking Transparency prompt before your device's advertising identifier can be used. If you allow it, ads may be personalized based on your activity across other apps and websites. If you decline, you will still see ads, but they will not be personalized that way.
On Android, ads may be personalized using your device's advertising ID. You can reset or delete your advertising ID in your device settings to limit personalization.
OrbView Pro subscribers do not see ads.
Technical and Server Log Data
When your device communicates with our servers (to fetch satellite or weather data, or to register for notifications), standard technical information such as your IP address may appear in server access logs. These logs are used solely for security monitoring and error diagnosis. Logs are retained for a maximum of 30 days and are not used for tracking or profiling.
2. How We Use Your Information
We use the information described above exclusively to:
- Compute and display satellite pass predictions for your location
- Show sky conditions for your location
- Deliver Daily Brief notifications at your chosen time, if you turn them on
- Display advertising to free-tier users (personalized only as described above)
- Understand aggregate usage patterns to improve the App
- Monitor server security and diagnose technical issues
- Process and verify subscriptions (handled by Apple's App Store or Google Play)
We do not use your data to build behavioral profiles, make automated decisions about you, or for any purpose not listed above.
3. Information We Share
We do not sell, rent, or trade your personal information. We share data only as follows:
Service Providers
We use third-party service providers to operate the App, including providers for analytics, advertising, weather data, push notification delivery, subscription management, and backend infrastructure. These providers may use your data only to provide services to us, except that advertising partners may also use data as described under "Advertising Identifiers" above and in their own privacy policies.
Subscription Processing
Subscription purchases are processed by Apple through the App Store or by Google through Google Play. We and our subscription management provider receive a record of your purchase and subscription status, linked to a random identifier rather than your name or email address. We do not receive or store your payment card information.
Legal Compliance
We may disclose information when required by applicable law, court order, or valid legal process, or when we believe disclosure is necessary to protect the rights, property, or safety of the Company, our users, or the public.
Business Transfers
If we are involved in a merger, acquisition, financing, or sale of all or a portion of our business or assets, your information may be transferred as part of that transaction. We will provide notice of any such transfer and any choices you may have to the extent required by applicable law.
4. Data Retention
Data stored locally on your device persists until you delete the App or clear its data through your device settings. Daily Brief registrations (push token, coordinates, location name, notification time, and timezone) are stored on our servers until you turn off Daily Brief, at which point they are deleted. If you delete the App without turning off Daily Brief first, contact us and we will delete your registration. Server access logs are deleted after a maximum of 30 days. Analytics data may be retained for longer periods for trend analysis and is not linked to your name or contact details.
5. Your Rights and Choices
Location Access
You can revoke location permission at any time in your device settings. Without it, the App uses a default location, so predictions will not match your sky.
Advertising
On iPhone, you can change your tracking choice at any time under Settings → Privacy & Security → Tracking. On Android, you can reset or delete your advertising ID in your device's ads settings (on most devices, Settings → Google → Ads or Settings → Privacy → Ads).
Notifications
You can disable all notifications at any time in your device settings. You can turn Daily Brief and pass alerts on or off in the App's Profile tab.
Deletion
All locally stored data is deleted when you uninstall the App. To request deletion of any server-side data (such as your Daily Brief registration), contact us at [email protected] and we will process your request within 30 days.
California Residents (CCPA / CPRA)
California residents have the right to know what personal information we collect and how it is used, to request deletion of their personal information, to correct inaccurate personal information, and to opt out of the sale or sharing of their personal information. We do not sell personal information. Personalized advertising may count as "sharing" under California law; you can opt out by declining tracking on iOS or deleting your advertising ID on Android, or by contacting us. To exercise your rights, contact us at [email protected]. We will not discriminate against you for exercising any CCPA right.
EEA, UK, and Switzerland Residents (GDPR / UK GDPR)
If you are located in the European Economic Area, United Kingdom, or Switzerland, you have the right to access, rectify, erase, and port your personal data, and to object to or restrict certain processing. Our legal bases for processing are: consent (location data, Daily Brief notifications, personalized advertising); legitimate interests (analytics, non-personalized advertising, server security logs); and contract performance (providing Pro features to subscribers). To exercise your rights, contact us at [email protected]. You also have the right to lodge a complaint with your local data protection authority.
6. Children's Privacy
OrbView is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
If you are a parent or guardian and believe your child has provided personal information to us that was not appropriately authorized, please contact us at [email protected] and we will promptly delete it.
7. Security
We implement industry-standard security measures, including HTTPS encryption for all data in transit. However, no transmission or storage method is completely secure. We cannot guarantee absolute security and disclaim liability for unauthorized access beyond our reasonable control.
8. International Data Transfers
The App is operated from the United States. By using the App from outside the United States, you acknowledge that your information may be transferred to, stored in, and processed in the United States or other countries, which may have data protection laws that differ from those in your jurisdiction. Where required by applicable law, we ensure appropriate safeguards are in place for such transfers.
9. Changes to This Policy
We may update this Privacy Policy at any time. We will indicate the date of the most recent revision at the top of this document and, where practicable, provide in-app notice of material changes. Your continued use of the App following any update constitutes your acceptance of the revised policy.
